The Pirate Bay is now owned by Sweden

After a court ruling on Tuesday, the Stockholm District Court awarded the Swedish state the domain names of the world’s largest BitTorrent indexer. The Pirate Bay used piratebay.se and thepiratebay.se to index mostly digital media content. Since it was founded, the primary concern is how to protect copyright.

The case is unique in Sweden as it is the first time that a prosecutor had demanded for a domain name to permanently disappear from the internet. Earlier this year, Swedish prosecutor Fredrik Ingblad told the Swedish Daily “A domain name assists a website. If the site is used for criminal purposes the domain name is a criminal instrument”.

However, prohibition of the domain names was opposed by Sweden’s Internet Infrastructure Foundation. The foundation controls the Swedish top level domain .se and only runs a mailing list. The district court acknowledges that it could not force the foundation to block certain domain names, but it also agrees that the foundation has not acted improperly. Consequently, it awarded the Pirate Bay addresses to the Swedish state to ensure that no one else can own them.

In 2003, Pirate Bay was founded in Sweden and it grew into an international phenomenon as it lets users dodge copyright fees and share copyrighted materials like films and music using bit torrent technology. As a result, music and movie makers suffered huge losses.

In December last year, police seized The Pirate Bay servers causing them to temporarily go offline. But after almost two months, it went back online. The court may have knocked the file sharing service offline but they know that they can’t prevent it from running another one with a new domain name. Still, this just might be the start of a domino effect with EZTV’s shut down following after The Pirate Bay.
